JEPSON CONSULT is experienced in the use of the FIDIC Rainbow suite of contracts (1999 and 2017 editions) having been involved in major claims, disputes, DAB, or DAAB and Arbitration proceedings under the Red, Pink, Yellow, Silver, Green and Blue Books on a variety of major infrastructure projects (civil engineering and building), process plants, pipelines and wind farm projects, oil and gas projects, hydropower and power transmission projects, marine, shipbuilding and platform works in Europe, Africa, Caribbean, Middle East and Far East. The 2017 FIDIC forms have significant changes from the 1999 editions and contain increased volume. The 2017 Red Book is 106 pages compared to only 62 pages in the 1999 edition. Hence The 2017 FIDIC forms contain considerably more procedure including notice requirements. The 2017 Red Book provides for 51 notices to be served by the Contractor and 64 notices by the Engineer or Employer and is administrative heavy compared to the 1999 edition. This additional administrative burden extends to the 2017 yellow and silver books. A number of the notice requirements are in condition precedent terminology and have strict time limits for service. Employers, contractors and specialist subcontractors may wish to consider the old adage that prevention is better than cure (and generally much less expensive) and acquaint themselves with content of the 2017 editions with the assistance of JEPSON CONSULT who can provide the necessary guidance and advice early on in the life of a project (including if required in-house training with course notes).
